Acceptance of Terms

Welcome to Nexus Athletica (“Nexus,” “we,” “us,” or “our”). By accessing or using our website, purchasing products, or enrolling in any Nexus Elite Athletic Academy program, you agree to be bound by these Terms of Service (“Terms”).

If you are a parent or guardian enrolling a minor in our academy, you agree to these Terms on behalf of yourself and that minor. If you do not agree to these Terms, please do not use our services.

These Terms apply to all visitors, customers, registered members, and academy participants. They are effective as of the date listed above.

Our Services

Nexus Athletica operates two distinct services under one brand:

• Nexus Athletica Storefront — an e-commerce shop offering premium sportswear, athletic gear, and accessories.
• Nexus Elite Athletic Academy — a youth sports training program offering structured coaching, clinics, and competitive preparation across multiple sports including Track & Field, Golf, Swimming, and Flag Football.

We reserve the right to modify, suspend, or discontinue any part of our services at any time with or without notice. We will not be liable to you or any third party for any such changes.

Accounts

Certain features of our website require you to create an account. When you register, you agree to:

• Provide accurate, current, and complete information
• Maintain the security of your password and account credentials
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms, contain fraudulent information, or are involved in abusive activity. You may not create accounts on behalf of others without their explicit permission.

Academy Enrollment

Enrollment in Nexus Elite Athletic Academy programs is subject to the following conditions:

Eligibility

• Programs are open to youth athletes within the age ranges specified per sport.
• Enrollment requires completion of our registration form and payment of program fees.
• For athletes under 18, a parent or legal guardian must complete the registration and provide verifiable consent.

Medical Information

• You agree to provide accurate and complete medical, allergy, and emergency contact information during registration.
• You understand this information may be accessed by coaches and staff to ensure athlete safety.
• You agree to promptly update us if any medical information changes during the program season.

Assumption of Risk

Athletic activity involves inherent risks of injury. By enrolling an athlete, you acknowledge and accept these risks. Nexus Athletica takes reasonable precautions to ensure participant safety but cannot guarantee that injuries will not occur.

Code of Conduct

All athletes and accompanying parents or guardians are expected to conduct themselves respectfully toward coaches, staff, fellow athletes, and spectators. Nexus Athletica reserves the right to remove any participant from the program without refund for conduct that is disruptive, abusive, or harmful to others.

Purchases & Returns

All purchases made through the Nexus Athletica storefront are subject to the following terms:

Orders

• By placing an order, you represent that you are authorized to use the payment method provided.
• We reserve the right to refuse or cancel any order at our discretion, including cases of suspected fraud or pricing errors.
• Product availability is not guaranteed. If an item becomes unavailable after you order, we will notify you and issue a full refund.

Returns & Exchanges

• Unused, unwashed items in original condition may be returned within 30 days of delivery for a full refund or exchange.
• Items marked as final sale are not eligible for return.
• To initiate a return, contact us at nexusathletica@gmail.com.

Shipping

Shipping estimates are not guaranteed. We are not responsible for delays caused by carriers, customs, or events outside our control. Risk of loss passes to you upon delivery to the carrier.

Payments

All fees are stated in US dollars. By providing payment information, you authorize us to charge the applicable amount using our payment processor.

• Storefront — Payment is collected at the time of purchase.
• Academy programs — Registration fees may be paid in full or via the installment plan selected during enrollment. You authorize all scheduled charges for the selected plan.
• Failed payments — If a payment fails, we will attempt to notify you. Failure to resolve a failed payment may result in suspension from the program or cancellation of your order.
• Refunds — Academy registration fees are non-refundable after the program start date except in cases of documented medical necessity or program cancellation by Nexus Athletica.

We do not store your full card number. Payment processing is handled by a PCI-compliant third-party processor.

Acceptable Use

You agree not to use our website or services to:

• Violate any applicable local, state, or federal law or regulation
• Transmit any harmful, offensive, or fraudulent content
• Attempt to gain unauthorized access to our systems or data
• Scrape, harvest, or collect user data without our written consent
• Interfere with the proper functioning of our website or services
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity

Violation of these restrictions may result in termination of your account and legal action where appropriate.

Intellectual Property

All content on this website — including but not limited to text, images, logos, graphics, video, and software — is the property of Nexus Athletica or its licensors and is protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, or commercially exploit any content from this website without our prior written consent. Personal, non-commercial use is permitted provided you retain all copyright and other proprietary notices.

The Nexus Athletica name, logo, and all related marks are trademarks of Nexus Athletica. Nothing in these Terms grants you a license to use our trademarks.

Disclaimer

Our website and services are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that our website will be uninterrupted, error-free, or free of viruses or other harmful components. We make no warranties regarding the accuracy, reliability, or completeness of any content on our website.

Limitation of Liability

To the fullest extent permitted by applicable law, Nexus Athletica and its officers, employees, agents, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising from or related to your use of our services.

Our total liability to you for any claim arising from these Terms or your use of our services shall not exceed the greater of (a) the amount you paid to us in the 12 months preceding the claim, or (b) $100.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for certain damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

Governing Law

These Terms are governed by the laws of the United States and the state in which Nexus Athletica is registered, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of our services shall be resolved exclusively in the courts located in that jurisdiction.

You waive any objection to the exercise of jurisdiction over you by such courts and to the venue of such courts.

Changes to Terms

We may update these Terms at any time. When we do, we will revise the “Last updated” date at the top of this page. For material changes, we will make reasonable efforts to notify registered users via email prior to the changes taking effect.

Your continued use of our services after any change constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using our services.
